Aloha Owners and Residents,

With things changing so rapidly, we felt that it was important to follow-up with you about the decision to close the Pool and Recreation facilities on March 20, 2020.

Article IV of the Wailea Fairway Villas Bylaws pertains to Administration and Section 1 pertains to Management, item “a” states the following:

  1. “Powers. The Board shall at all times manage and operate the Project and have such powers and duties as may be necessary or proper therefore including without limitation the following:
  • Supervision of the immediate management and operation of the Project”

The Board discussed this at great length and determined unanimously that closing the facilities was the best way to comply with the Mayor’s orders. Not only do we have a fiduciary duty to comply with the Mayor’s and Governor’s orders, but we also have a social responsibility to do whatever we can to slow the spread of the virus.

Gyms have been ordered closed and enforcing the “no more than 10 people gathering at once” at the pool is very challenging to manage from an operations perspective, as it is often crowded at different times of the day. Social distancing of 6 feet is also not possible in the spa.

Other properties in the area have also shut down their facilities for similar reasons.

We will of course continue to maintain the pool and spa in order to ensure that it stays in excellent condition when the time comes to re-open the facilities. This will, however, be less frequent than our normal schedule due to the fact that we have no bather loads at this time.

Lastly, we implore you to adhere to the ruling by the Board of Directors on the closure of the Pool and Recreation Facilities.  Please be aware that violation of this ruling is punishable as a misdemeanor, with fines of up to $5,000, up to a year in jail, or both.  Please do not violate this ruling as the Association will be obligated to report all infractions to the County. We will also be left with no choice other than to issue violation notices and fines as outlined in our House Rules.
